1. Operator
The operator of the Tomic Lightings service (hereinafter the "service" or the "application") and of the tomic.cz website is:

2. Subject of the service
Tomic Lightings is a desktop application for Windows used to control stage and club lighting over DMX (ArtNet, USB). The application is distributed in two variants:
- Free version — freeware limited to 2 DMX universes (1,024 channels), 50 fixtures, 50 scenes and 50 sequences
- Full version — a paid license, 999 Kč/year, or a one-time 4,999 Kč forever (all 4 DMX universes, no fixture, scene or sequence limits, personal technical support, commercial use)

3. License — Free version
The Free version is provided free of charge and with no time limit for personal, non-commercial use. Specifically:
- You may use it freely, copy it to other devices and install it on your own laptop.
- You may not resell it or distribute it as part of a paid service.
- You may not modify it, decompile it or derive your own products from it.
- Commercial use (paid shows, an agency, a desk rental company, a professional lighting operator as a service) requires a MIDI or Full license.
The free version is limited to 2 DMX universes (out of 4), 50 fixtures, 50 scenes and 50 sequences. Groups, faders and palettes may be created in unlimited numbers. These limits distinguish the free version from the paid licence; they are not a trial period.
4. License — MIDI and Full version
The paid version (Full — 999 Kč/year, or a one-time 4,999 Kč forever) is provided under a license at the price listed in the pricing. The license is tied to a specific user (a natural person or a legal entity), not to a specific device — you may install it on several laptops (e.g. main and backup) as long as the same user works on them.
When the annual license expires:
- The application returns to Free-version mode.
- Existing show data remains accessible. If it exceeds the Free version's limits, no new items can be created in it, but it can be edited and played back.
- To continue with an annual license, the license is renewed for another year (999 Kč again). The one-time license (4,999 Kč) is valid forever and is not renewed.
No automatic card renewal. It is always a one-time payment for 12 months ahead, which you have to renew yourself.
5. Payment and invoice
Payment is made by bank transfer against an issued invoice. Within 2 business days of receiving the payment, a license key is issued and sent by e‑mail, unlocking the respective version (MIDI or Full).
For VAT payers an invoice with VAT can be issued (state your company ID / VAT ID when ordering).
6. Withdrawal from the contract
For digital content (the license key) the consumer has the right to withdraw from the contract within 14 days of its conclusion, provided that:
- The key has not yet been used to activate the full version, OR
- The full version demonstrably cannot be run on the user's hardware (it does not meet the system requirements) and the user could not reasonably have prevented this.
In other cases (key used, full version active) withdrawal is subject to the usual rules for digital content — contact us by e‑mail.
7. Limitation of liability
The Tomic Lightings application is distributed "as is". I develop it with the utmost care, but:
- I am not liable for damage caused by improper use, a faulty fixture patch, incorrect DMX wiring, or hardware failure (laptop, interface, network, cables, fixtures).
- I am not liable for outages during a live show caused by an error in the application, the OS, or the environment — I always recommend a backup desk / backup laptop for productions where an outage is critical.
- Functionality with specific fixtures depends on the correctness of the GDTF profile / custom profile. When in doubt, verify the profile at a rehearsal beforehand.
The operator's aggregate liability is limited to the amount of the license price paid by the user in the preceding 12 months.
8. Personal data protection
When you contact me by e‑mail, I process only the data you share with me yourself — typically your e‑mail address, name and possibly billing details. This data:
- Is used exclusively for communicating with you and issuing the invoice.
- Is never sold or shared with third parties.
- Is kept only as long as strictly necessary (typically 10 years for tax documents as required by law).
The tomic.cz website itself does not actively collect any personal data — there is no analytics running, no form, no registration. Web server logs contain the usual technical records (IP address, request time, browser) — they serve for attack detection and are rotated.
You have the right to access, rectify, erase and port your data — just send an e‑mail.
9. Cookies
The tomic.cz website uses only technically necessary cookies / localStorage:
tomic_cookie_consent(localStorage) — remembers that you have given consent to cookie processing. Without it, the cookie bar would show on every visit.
No analytics, advertising or tracking cookies are used. There is no Google Analytics, Facebook Pixel or any similar tool on the site.
If you nevertheless want to delete all data about you, open the browser developer tools (F12), the "Application" tab → "Local Storage" → tomic.cz, and delete the tomic_cookie_consent key.
10. Changes to the terms
I may amend these terms at any time — the current version is always on this page. The date of the last update is at the bottom. If they change substantially (especially the pricing or the license terms), I will notify active full-version users by e‑mail.
